Terms of Service

theName.app Effective Date: 15 July 2026 Last Updated: 15 July 2026

_This document is under active legal review and will continue to be refined before public launch._

1. Acceptance of Terms

By accessing or using theName.app (the "Platform"), including our mobile applications (iOS, Android), web application, desktop application, and any related services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Services.

The Platform is operated by TNAP PLATFORMS PRIVATE LIMITED, a company incorporated under the laws of India, with its registered office at 43 Residency Rd, Bangalore – 560025, Karnataka, India ("Company", "we", "us", "our").

2. Eligibility

2.1. India: You must be at least 18 years of age to create an account or use the Services in India. The Services are not offered to persons under 18 in India.

2.2. Other countries: If you sign up from outside India, you must be at least 13 years of age, or the minimum age required to consent to the processing of personal data in your country, whichever is higher.

2.3. Date of birth: You must provide your correct date of birth at signup. Your date of birth is used to verify eligibility (and for optional birthday features) and cannot be changed after signup except through a verified support request.

2.4. The Services are never intended for children under 13 years of age. We do not knowingly collect personal data from children under 13, and we delete such data promptly if discovered.

2.5. By using the Services, you represent and warrant that you meet the eligibility requirements for your country and have the legal capacity to enter into a binding agreement.

3. Account Registration

3.1. To use the Services you must create an account with a valid phone number and complete the verification process. Anonymous browsing of limited public surfaces (such as the public feed and shop on the web) does not require an account.

3.2. Early access: During alpha/beta periods, account creation may require an invite from an existing member or approval from our waitlist. Invites are personal, limited in number, and may not be sold or exchanged for money.

3.3. Your @name: At signup you claim a unique username ("@name"). Your @name identifies you across the Platform and also serves as your Platform email address (yourname@thename.app). @names of deleted accounts are permanently retired and are not reissued to other users.

3.4. You are responsible for maintaining the security of your device and account and for all activities that occur under your account. You agree to provide accurate, current, and complete information and to keep it updated.

3.5. One person may maintain only one personal account per phone number. Business profiles (seller, restaurant, host, Partner) operate as linked roles under your personal account. Creating deceptive or fraudulent accounts may result in termination of all associated accounts.

3.6. We may suspend or terminate your account if any information provided proves to be inaccurate, outdated, fraudulent, or incomplete.

4. Platform Services

The Platform provides the following services, which may vary by country and roll out progressively:

4.1. Content Feed: Short and long-form video and post feeds (Clips, Posts, Videos) where users can view, create, and share content.

4.2. Connect: End-to-end encrypted 1:1 and group messaging (Spaces), voice and video calling, and a Platform email and calendar service tied to your @name address.

4.3. Shop / Marketplace: A marketplace where registered sellers can list and sell products and services to users.

4.4. Hyperlocal Services: Local services such as food delivery, rides, and stays, fulfilled by restaurants, hosts, and independent Partners (see Section 8). Availability is limited to supported cities.

4.5. Blessings Reward Program: A promotional reward credit system where users earn non-monetary credits ("Blessings") governed by Section 5 and the separate Blessings Reward Program Terms.

4.6. Creator Tools: Tools for content creators including analytics, studio features, and revenue participation programs.

4.7. Namiel: An AI assistant built into the Platform, formerly known as "Angel AI" (see Section 9).

4.8. Additional Services: Such as search, maps, business tools, and other features made available from time to time.

5. Blessings — Promotional Reward Credits

5.1. Nature of Blessings: Blessings are non-monetary promotional reward credits distributed by the Company from its advertising revenue. Blessings are NOT money, legal tender, currency, digital assets, virtual digital assets, securities, deposits, prepaid payment instruments, or any form of stored value. Blessings represent a share of advertising revenue that the Company, at its sole discretion, allocates to users who engage with advertising content on the Platform.

5.2. Earning: Blessings can only be earned through engagement with advertising content and other activities as specified by the Company (including referral and invite rewards during early access). Blessings cannot be purchased, loaded, topped up, or acquired through any means involving the payment of money by users.

5.3. Spending: Blessings may be used to acquire goods and services available on the Platform's marketplace, subject to seller acceptance and applicable terms.

5.4. Sharing: Users may share Blessings with other users on the Platform as a gift of reward credits. Such sharing does not constitute a financial transaction, money transfer, or payment.

5.5. Redemption: Eligible users who have completed identity verification (KYC) may request the Company to settle their accumulated Blessings by way of a revenue share distribution to their verified bank account. Such settlement is a discretionary distribution of the Company's advertising revenue and is not a withdrawal, payment, or cashout of user funds. Settlement may be unavailable at launch, in certain regions, or during certain periods, and the Company may set minimums, daily limits, and processing fees.

5.6. No Guarantee of Value: The Company reserves the right to modify Blessings earning rates, spending options, redemption terms, and conversion rates at any time. Blessings have no guaranteed cash value and no value outside the Platform.

5.7. Expiry and Forfeiture: Blessings may be subject to expiry as specified in the Blessings Reward Program Terms. Upon account termination, any unredeemed Blessings are forfeited and have no cash equivalent.

5.8. Tax Responsibility: Users are solely responsible for any tax obligations arising from the receipt or redemption of Blessings under applicable law.

5.9. The complete terms governing Blessings are set forth in the Blessings Reward Program Terms, which are incorporated herein by reference.

6. User Content

6.1. Ownership: You retain ownership of the content you create and upload to the Platform ("User Content").

6.2. License Grant: By uploading User Content, you grant the Company a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, display, perform, modify, and create derivative works of your User Content in connection with operating, promoting, and improving the Services.

6.3. Content Responsibility: You are solely responsible for your User Content. You represent and warrant that you have all necessary rights to upload and share your User Content and that it does not infringe any third party's rights.

6.4. Content Standards: User Content must not:

  • Contain illegal, harmful, threatening, abusive, defamatory, or obscene material
  • Infringe any intellectual property rights, privacy rights, or other rights of any person
  • Contain malware, viruses, or harmful code
  • Promote violence, discrimination, or illegal activities
  • Contain unauthorized advertising or spam
  • Impersonate any person or entity
  • Violate any applicable law or regulation

6.5. Content Moderation: We reserve the right to review, remove, or restrict access to any User Content that violates these Terms or our content policies, without prior notice. We use a combination of automated systems and human review for content moderation of public content. End-to-end encrypted private messages are not scanned (see Section 10). Moderation decisions affecting your content or account can be appealed through the in-app Account Status Center.

6.6. DMCA / Copyright: If you believe your copyrighted work has been infringed on the Platform, please send a notice to our designated agent at copyright@thename.app, or use the form at https://legal.thename.app — our Copyright Policy (https://legal.thename.app/copyright) lists what the notice must contain and how a counter-notice works.

7. Marketplace

7.1. Intermediary Role: The Company operates the marketplace as an intermediary platform connecting buyers and sellers. The Company is not a party to transactions between buyers and sellers and does not own, sell, or resell any products listed on the marketplace.

7.2. Seller Responsibility: Sellers are responsible for the accuracy of their product listings, fulfillment of orders, product quality, compliance with applicable laws (including consumer protection laws, GST, and product safety standards), and handling of returns and refunds in accordance with the marketplace policies. Sellers must complete identity verification (KYC) before selling.

7.3. Buyer Protection: The Company facilitates dispute resolution between buyers and sellers but is not liable for the quality, safety, legality, or delivery of products sold through the marketplace.

7.4. Payment: Supported payment methods vary by region and may initially be limited (for example, cash on delivery for local orders). Where online payments are offered, they are processed by licensed third-party payment providers.

7.5. Commission: The Company charges sellers a commission on each completed transaction. The commission rate and payment terms are specified in the Marketplace Seller Agreement.

7.6. Prohibited Items: Certain categories of products are prohibited from being listed on the marketplace. The prohibited items list is published separately and updated from time to time.

8. Hyperlocal Services (Food Delivery, Rides, Stays)

8.1. Intermediary Role: For hyperlocal services, the Company acts as a technology platform connecting you with restaurants, hosts, and independent delivery/ride partners ("Partners"). The Company does not itself prepare food, provide transport, or operate accommodations.

8.2. Partners: Partners are independent service providers, not employees or agents of the Company. Partners must complete identity verification and applicable background checks before going online.

8.3. Restaurants and Hosts: Restaurants are responsible for food quality, hygiene, licensing (including FSSAI compliance), and accurate menus. Hosts are responsible for the accuracy, safety, and legality of their listings.

8.4. Pricing and Fees: Fares, delivery fees, and service fees are shown before you confirm an order or ride and may include distance, time, and demand-based components. Cancellation fees may apply after a partner has been assigned.

8.5. Safety: Rides and deliveries include safety features such as live trip tracking, trip sharing, pickup verification codes, and an SOS function. In an emergency, always contact local emergency services first.

8.6. Availability: Hyperlocal services are available only in supported cities and may be introduced, modified, or withdrawn per market.

9. Namiel

9.1. Namiel (formerly "Angel AI") is an AI assistant integrated into the Platform. Responses are generated by artificial intelligence and may be inaccurate, incomplete, or unsuitable for your situation. Namiel is not a substitute for professional (medical, legal, financial, or safety) advice.

9.2. Your Namiel conversations are processed to provide the feature, including through vetted third-party AI infrastructure, and are stored encrypted at rest. See the Privacy Policy for details.

9.3. You must not use Namiel to generate content that violates Section 6.4 or applicable law.

10. Messaging, Calls, and End-to-End Encryption

10.1. The Platform's Connect messaging (1:1 and Spaces) and calls are protected by end-to-end encryption ("E2EE"). When E2EE is active, content is encrypted on the sender's device and can only be decrypted by the intended recipient(s). The Company cannot access the content of E2EE messages or calls.

10.2. E2EE does not apply to metadata (such as sender, recipient, timestamps, and delivery status), which may be collected and processed as described in our Privacy Policy. Platform email sent to or from external providers is transported using standard email security and is not end-to-end encrypted.

10.3. You are responsible for safeguarding your devices and, if enabled, your encrypted backup PIN. Loss of keys or backup credentials may result in permanent inability to access message history. Linked devices (such as the web app) receive keys through your primary device.

10.4. The Company complies with applicable laws regarding lawful interception and disclosure. Users acknowledge that the Company may be required to comply with court orders or lawful government requests, to the extent technically feasible given the E2EE architecture.

11. Intellectual Property

11.1. The Platform, including its design, features, code, brand elements, trademarks, and all content created by the Company, is the exclusive property of the Company and is protected by intellectual property laws.

11.2. You may not copy, modify, distribute, sell, or create derivative works based on the Platform or any Company-owned content without prior written consent.

11.3. The theName.app name, logo, and brand marks are trademarks of the Company. You may not use them without prior written permission.

12. Prohibited Conduct

You agree not to:

12.1. Use the Services for any unlawful purpose or in violation of any applicable law or regulation.

12.2. Use bots, scripts, or automated tools to interact with the Services, including to artificially inflate Blessings earnings, engagement metrics, or follower counts.

12.3. Attempt to manipulate, game, or exploit the Blessings system or invite/referral rewards through fraudulent engagement, collusion, multiple accounts, or any other deceptive practices.

12.4. Interfere with or disrupt the Services, servers, or networks connected to the Services.

12.5. Harvest, collect, or store personal data of other users without their consent.

12.6. Circumvent, disable, or interfere with security features of the Services, including E2EE, age verification, or the invite gate.

12.7. Use the Services to send spam, unsolicited messages, or unauthorized advertising.

12.8. Resell, sublicense, or commercially exploit the Services (including invites) without authorization.

13. Termination and Account Deletion

13.1. By You: You may delete your account at any time through Settings → Account, or through our web deletion page. Deletion is scheduled with a 30-day grace period: signing in again within 30 days cancels the deletion; after 30 days the deletion becomes permanent and your encryption keys are destroyed. Certain records are retained after deletion where required by law, as described in the Privacy Policy. Your @name is permanently retired. Any unredeemed Blessings are forfeited.

13.2. Content after deletion: Content you posted publicly is removed or anonymized. Messages you already delivered to other people remain on their devices, consistent with how messaging services work.

13.3. By Us: We may suspend or terminate your account at any time for violation of these Terms, fraudulent activity, legal requirements, or any other reason at our sole discretion. We will make reasonable efforts to notify you, except where prohibited by law or where immediate action is necessary to protect the Platform or other users.

13.4. Effect of Termination: Upon termination, your right to use the Services ceases immediately. Sections that by their nature should survive termination (including intellectual property, limitation of liability, indemnification, and dispute resolution) shall survive.
